SERVICE TERMS & CONDITIONS
1. SERVICE ACCEPTANCE
1.1. Actual speed could vary due to various factors such as number of connected devices, type of activity and type of connection. A minimum speed at 60% of subscribed bandwidth with 150% burst speed and 80% service reliability within 24 hours period.
1.2. Customer Service, Technical Support or on-site assistance will be attended to in order of schedule and availability of the technical team, or any staff that are related to the operation.
1.3. Customer acknowledges that it is necessary for the Equipment and TECHGEEKPH network to undergo periodic preventive maintenance work which may affect the provision of the Service, and the customer further acknowledges that TECHGEEKPH is free from any liability on account of any loss or damage it may sustain during the performance of the maintenance work.
2. CUSTOMER RESPONSIBILITIES
2.1. Provide access and clearance to allow duly authorized TECHGEEKPH personnel to enter and leave the Customer’s premises at reasonable hours or at such frequency as may be necessary.
2.2. Provide due care to all TECHGEEKPH-owned equipment install in its customer premises. The provided customer information must be up-to-date and accurate.
2.3. Customer will be charged prior to requested assistance being provided, if the issue is deemed to be user error or other request and beyond this agreement.
2.4. Customer shall provide information or details must be accurate and up-to-date.
3. PAYMENT TERMS
3.1. Billing shall commence (30) day after activation of the Service. TECHGEEKPH has the option to provide the bill for the Service using any media available such as, but limited to, electronic mail, customer portal, or printed bill sent through our authorized personnel.
4. DISCONTINUANCE OF SERVICE
4.1. TECHGEEKPH has the option to discontinue the Service for non-payment of the overdue account with or without notice.
4.2. Customer shall pay any remaining balance dues within (30) days after disconnection notice.
5. FORCE MAJEURE
5.1. TECHGEEKPH shall not have any liability whatsoever or be deemed to be in default for any delay or failure in the performance and its obligations due to acts of nature such as but not limited to typhoon, flood, accidents, fires, cable break, delay or due to any other similar causes or those causes that are beyond its reasonable control.
6. LIMITATION OF LIABILITY
6.1. In no event shall TECHGEEKPH be liable for any loss of revenue, business opportunity or business advantage, loss of use, interruption of business, any indirect, incidental, special or consequential damages even if TECHGEEKPH has been advised of the possibility of such claims.
6.2. Non TECHGEEKPH devices such as TV, Computer, Laptop, Mobile Phones or any devices that are not provided by the company.
7. SERVICE INTERRUPTIONS AND REBATES
7.1. TECHGEEKPH may grant a rebate to Customer due to full network service interruption. Customer shall file a written claim for rebate with TECHGEEKPH within (7) days, otherwise said claim shall be deemed to have been irrevocably waived.
7.2. TECHGEEKPH shall validate the cause of the full services interruption within (7) days from the acknowledgement of the written claim. In the full services interruption is determined to have been caused by internal, faulty equipment or the fault or negligence of TECHGEEKPH, TECHGEEKPH shall grant a rebate to Customer equivalent of the MSF computed on the basis of the below computation, the full-service interruption of third party is not included under this agreement. see Section 5.
7.3. TEHCGEEKPH, at its sole discretion may set off any said rebates. The rebate shall be the only and exclusive remedy available to Customer and no other payment for compensation of any kind whatsoever shall be claimed by Customer against TECHGEEKPH arising from service interruption.
In the excess of 24 hours downtime.
REBATE = MSF / 30 days = Daily Rate
REBATE FEE = Daily Rate x No. of Days
8. DATA PRIVACY
8.1. Customer hereby authorized TECHGEEKPH to collect, process and store personal information that has been provided as may be necessary to provide the Service.
8.2. Details will be use for future references and for us to send updates, and notification regarding on the services.
CONFORME: Upon signing on this form, I hereby agree to subscribe to TECHGEEKPH Internet Service and agree to bound to TECHGEEKPH’s TERMS AND CONDITIONS as stated above.
